January 14 proposed agenda and for your consideration

Dear Talahi Lake Property Owners,

There has been controversy around your board’s recommendations for reorganizing and updating.
Things to consider and do:

Plan to come to our meeting on January 14. There will be continuing discussion that may aid your choices going forward.

You will have two opportunities to vote. The first one will be at our meeting on the 14th. Voting is by filling out a consent form. We will have a notary and consent forms available, although you are welcome to print Exhibit C the posted proposed POA. We will offer another opportunity to vote which will be announced soon. The results will be submitted to the County Clerk. Each form will be on file and reviewable by any property owner. They will be in the hands of our secretary. We are required to keep them for a period of years.

Some have asked if they can send a proxy to the meeting. NO, your witnessed and notarized signature is required on your consent form. Each property has one vote. If you cannot come or know a neighbor who cannot attend, please let us know and we will arrange a home visit.

Two of our property owners, Dan Host from Scarborough Cove and Wes Aaron from Suncrest have posted a link to a survey. It is one question. It was posted January 6. We hope everyone will complete the survey. It is NOT a vote. If you cannot access the survey online, let Dan or Wes know.

A couple of additional points:

There has been much written about liens and fines. There have been precious few liens in the history of the lake. Most have been over dues payment issues. Keep in mind that all of our owners in residence are, and have been, faithfully paying dues. New rules will only be passed by vote of the property owners. A lien is not any automatic or simple process. It is within the board’s power now to file a lien although It has not been done in years.

The existing covenants need to be brought up to date to withstand challenges. The POA will give the board authority for enforcement for current rules. Presently, it is unclear who has authority for enforcement. Even the question of gasoline powered engines, for example, can and have been challenged. The POA gives the board authority to enforce rules like that by becoming a POA.

The Talahi Lake Property Owners Association is currently a corporation. By becoming a POA, it does increase the power of the board, and also the power of the members. This will increase and require property owners ‘involvement allowing all of us to make changes and vote for board members.

All of the board members are your neighbors. We stand on the shoulders of people who have served this lake for more than 50 years. The only people you can elect are other neighbors. The POA gives all of us the framework to make changes. But you must start with a structure that holds the board accountable and gives you the power to do so.
